Thank you for visiting our webpages and using the Azerion Intelligence platform. When you use our platform and services, you may entrust us with your personal data. We are committed to treating your personal data with care and respect.

This Privacy Policy describes how Azerion Intelligence collects and uses your personal data in relation to the Azerion Intelligence platform and services (the “Service”).

This Privacy Policy does not apply to any products, services, or content that are offered by third parties having their own privacy policies, including the Large Language Model (LLM) providers accessible through our Service, or other products or services not explicitly covered by this Policy.

When you use the Azerion Intelligence Service, the controller of the personal data you provide in relation to your account and service administration is Azerion Intelligence (referred to as the “Company”, “We”, “Us”, or “Our”), with its primary place of business in Amsterdam, the Netherlands. For personal data contained within your Inputs to Models, you are typically the controller, and we act as a processor.

1. SOURCES OF PERSONAL DATA

Azerion Intelligence processes personal data provided by data subjects themselves or collected when they use our Service:

  • Registration Information: Required for registering for the Service, such as your email address and any other information you provide during onboarding.
  • Third-Party Account Sign-Up: If you choose to sign up for our Service through a third-party account (e.g., Google), where such functionality is offered, you authorize us to receive, store, and use information that you have agreed that such third party could provide to us through their API.
  • Inputs and Outputs: You provide Inputs when interacting with Models through the Azerion Intelligence interface (API or dashboard) and receive Outputs generated by those Models. As detailed below, we do not store your Inputs or Outputs for our own model training purposes.
  • Communications: Information you provide when you communicate with us by email, through our support channels, or otherwise. We may monitor and record communications for quality assurance, training, and to improve our Services, provided you have been duly informed or have consented where required by law.
  • Web Forms: Information you provide through web forms to be contacted by us or to submit requests or queries.
  • Identity Verification (if applicable): Information we may need to check your identity as part of our Know Your Customer (KYC) procedures or for fraud prevention, if such procedures are implemented.
  • Information on Behalf of Others: If you complete registration on behalf of another entity or provide information regarding another person, you represent that you were authorized by that person or entity to provide the submitted information.
  • Usage Data and Cookies: When you visit or access our Services, upon your consent where required, we may use (and authorize third parties to use) pixels, cookies, and other technologies (“Cookies”). This includes data about your interaction with our Platform, such as IP address, browser type, pages visited, and features used. 2. PERSONAL DATA WE PROCESS

Azerion Intelligence processes personal data related to its potential and current Customers (individuals or representatives of legal entities) and users of the Service and our website (https://azerion.ai, https://app.azerion.ai). The categories of processed personal data may include:

  • Identifiers: Full name, email address, phone number (if provided).
  • Professional Information: Job title, company name, company size, company industry (if provided).
  • Account Information: Information provided during registration, authentication or authorization data (e.g., encrypted passwords, API Keys).
  • Payment and Billing Details: Information required for processing payments for Credits and subscriptions, managed through our third-party payment processor (Stripe). We do not directly store full credit card numbers.
  • Support Information: Information contained in support requests and communications with us.
  • Inputs and Outputs:
    • Inputs: Queries or prompts you submit to the Models via the Service.
    • Outputs: Responses generated by the Models based on your Inputs.
    • Important Note: Azerion Intelligence does not store your Inputs or Outputs for the purpose of training its own AI models or for any purpose other than what is strictly necessary to provide the Service to you (e.g., transmitting to the selected LLM Provider, temporary caching for performance, and troubleshooting), unless you explicitly consent to such other use (e.g., for a Beta Service that specifically requires it). Inputs and Outputs are processed by the selected LLM Providers according to their respective terms and privacy policies.
  • Usage Metadata: Personal data Azerion Intelligence collects or generates during the provision and administration of the Service. This includes user identifiers, authentication credentials, resource identifiers and attributes, IP addresses, service settings and configurations, information about your preferences and usage of the Service (e.g., API call volume, features used, Credit usage). We collect information about operational status, software errors and crash reports, quality and performance metrics, and other technical details necessary for us to operate, maintain, bill for, and improve the Service.
  • Device and Browser Information: Type and device ID, identifiers from Cookies or tokens, browser type and version, operating system.
  • Location Information: General geographical location based on IP address.
  • Website Interaction Data: Service access times, statistics on page views, and time spent on pages, obtained through Cookies or similar technologies (subject to your consent where required).
  • Direct Communications Records: We may keep records of your communications and interactions with us (e.g., feedback, questions, support requests).

Please consider that some of the listed Personal Data (e.g., from non-essential Cookies) are processed only upon your consent.

Sensitive Personal Data: We do not intentionally collect sensitive personal data (e.g., information revealing race, ethnic origin, political opinions, religion, health data, biometric data for unique identification, etc.) through the general use of our Service, and we explicitly ask our users not to provide us with such information in Inputs or in general communications unless specifically requested by us for a legitimate purpose (e.g., accessibility requirements) and with appropriate safeguards in place. The Platform is not designed for the processing of sensitive personal data within Inputs.

3. WHY WE PROCESS YOUR PERSONAL DATA

We only collect and use personal data for purposes that are necessary and lawful. These purposes include:

  • Providing and Managing the Service:
    • To create, update, secure, and personalize your Account.
    • To enable access to the Platform, API, and Marketplace Applications.
    • To process payments for Credits and subscriptions.
    • To deliver and maintain our Services, including routing Inputs to LLM Providers and returning Outputs.
    • To fulfill support requests and respond to your inquiries.
    • To send you service-related notifications (e.g., about changes to our Services, security alerts, billing issues).
    • To take necessary steps to conclude and perform our agreement (Terms of Service) with you.
  • Improving and Developing the Service:
    • To analyze usage patterns, understand user needs, and improve the performance, features, and usability of our Services (e.g., based on aggregated and anonymized usage metadata).
    • To develop new features and services.
    • To determine the effectiveness of our promotional campaigns.
    • For analytics, statistical, development, and research purposes (typically using aggregated or de-identified data).
    • This is generally based on our legitimate interest to provide and enhance our offerings.
  • Legal, Security, and Compliance:
    • To comply with applicable legal obligations, judicial enforcement, and administrative orders.
    • To protect and enforce our rights, privacy, security, and property, as well as those of our users, LLM Providers, and other third parties.
    • To resolve disputes.
    • To verify your identity if necessary (e.g., for KYC checks, fraud prevention).
    • To detect and prevent fraud, abuse, security incidents, and other harmful activities.
    • To perform audits and internal checks to ensure compliance with legal, contractual, and regulatory requirements.
  • Marketing and Communications (with your consent where required):
    • To send you notifications, messages, and promotional updates about new features, offerings, events, and special opportunities or other information we think our Customers and users may find valuable.
    • We may provide such notices through various contact means (e.g., email, web notifications), through our websites, or through marketing campaigns on other sites.
    • You can opt-out of promotional communications at any time through your Account settings or by using the unsubscribe links provided in the communications.

Some laws, particularly outside the European Economic Area (EEA), may require your consent for us to process certain personal data. Where this is the case, by accessing, viewing, and using our websites and Service, you consent to the processing of your personal data as described in this Privacy Policy, to the extent such consent is the appropriate legal basis. You have the right to withdraw your consent at any time for future processing, which will not affect the lawfulness of processing based on consent before its withdrawal. For many processing activities, especially within the EEA, we rely on other legal bases such as contractual necessity or legitimate interests.

5. TO WHOM WE DISCLOSE YOUR PERSONAL DATA

We may disclose certain personal data to the following categories of recipients, to the extent required or permitted by applicable law, based on our contractual obligations, legitimate interests, your consent, or legal requirements:

  • Affiliate Entities: Companies within the Azerion group of companies that are involved in operating our business activities or providing parts of the Service, including for support and technical maintenance.
  • LLM Providers: When you use the Service to send Inputs to Models, we transmit your Inputs to the selected LLM Providers (e.g., OpenAI, Meta, Anthropic, Mistral) for processing, and they return Outputs through our Service. These LLM Providers process your data according to their own terms and privacy policies.
  • Infrastructure Providers: We use third-party infrastructure providers (e.g., AWS Bedrock, Huawei for hardware/GPUs, Google Cloud Platform) to host and operate our Platform and Service. These providers may have access to data stored on or processed through their systems as necessary to provide their services.
  • Payment Processors: We use Stripe for payment processing. When you purchase Credits or subscribe to Marketplace Applications, your payment information is provided directly to Stripe, which processes it according to its privacy policy.
  • Other Third-Party Vendors: Service providers who assist us with various business operations, such as CRM systems, email service providers, analytics tools, legal advisors, and accountants. These vendors are authorized to use your personal data only as necessary to provide services to us and are typically bound by confidentiality obligations.
  • Public Authorities: If and exclusively when strictly necessary to comply with our legal obligations, or to respond to lawful requests from law enforcement, courts, or other government authorities.
  • Other Third Parties: To enforce our Terms of Service, protect our rights, privacy, safety, or property, or that of our users or the public.
  • Business Transitions: In the event that Azerion Intelligence goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal data may be among the assets transferred. Any such transfer will be subject to commitments consistent with this Privacy Policy or as otherwise required by applicable law.
  • Marketing and Analytics Vendors (with your consent): We may share data (often aggregated or de-identified, or based on Cookies) with third-party marketing and analytics vendors (e.g., Google Analytics) to help us understand how our websites are used and to optimize our marketing efforts.

We will not sell your personal data in the traditional sense without your explicit consent. We will not use your Inputs or Outputs to train our own models or for purposes other than providing and improving the Service as described herein, without your explicit consent.

6. INTERNATIONAL DATA TRANSFERS

We primarily store and process your personal data within our data centers located in the European Union, aligning with our Europe-first strategy. However, as we operate globally and utilize global third-party service providers (including LLM Providers and infrastructure providers), your personal data may be processed and transferred to countries outside the EU/EEA, including countries that may not have received an adequacy decision from the European Commission.

When we transfer your personal data outside the EU/EEA to such countries, we are fully committed to ensuring the safeguard and protection of your personal data. We implement appropriate measures in this regard, including:

  • Relying on Standard Contractual Clauses (SCCs) adopted by the European Commission (and their approved equivalents for the UK and Switzerland, where applicable) for transfers to third parties.
  • Verifying that the recipient has implemented adequate technical and organizational measures to protect the data.
  • Implementing internal policies and procedures to limit access to personal data and ensure awareness of data protection obligations.

7. RETENTION OF YOUR PERSONAL DATA

We retain your personal data only for as long as it is necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. The exact length of time will vary depending on the type of data, the purpose of processing, the category of users involved, and our legal or operational needs.

Key considerations for retention periods include:

  • Account Data: Retained for as long as your Account is active and for a reasonable period thereafter to allow for account reactivation or to comply with legal obligations.
  • Billing and Transaction Data: Retained for periods required by tax and accounting laws (e.g., typically 7-10 years).
  • Usage Metadata: Retained as long as necessary for service improvement, billing, security, and analytics, often in aggregated or de-identified form for longer periods.
  • Communications: Retained for as long as necessary to address your inquiry or for record-keeping purposes.
  • Inputs/Outputs: As stated, we do not persistently store your Inputs or Outputs for our own model training. Temporary storage may occur for service delivery and troubleshooting, typically for short durations.

Non-personal data (e.g., aggregated or anonymized data) may be retained and used by Azerion Intelligence without limitation, particularly for archiving, public interest, statistical, historical, or scientific research purposes.

8. COOKIES AND SIMILAR TECHNOLOGIES

We use cookies and similar tracking technologies (e.g., pixels, web beacons) to track activity on our websites (https://azerion.ai, https://app.azerion.ai) and store certain information. Cookies that are not strictly necessary for the functioning of the websites are collected and stored based on your consent.

9. SECURITY

Azerion Intelligence is dedicated to ensuring the security of your personal data. We have implemented and maintain appropriate technical, administrative, and physical security measures designed to protect the personal data we process against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. We strive to ensure these measures are state-of-the-art and are regularly reviewed and tested.

Despite our best efforts, please keep in mind that no security measures are impenetrable, and no website or internet transmission is ever completely secure. We cannot guarantee (i) that unauthorized access, hacking, data loss, or other breaches will never occur; or (ii) the absolute security of your data. Any transmission of personal data is at your own risk. You are also responsible for maintaining the security of your Account credentials and API Keys.

10. CHILDREN'S PRIVACY

Our websites and Service are not intended for use by individuals under the age of 18. We do not knowingly collect or process personal data from anyone under the age of 18. If you are a parent or guardian and you become aware that your child under 18 has provided us with personal data without your consent, please contact us immediately at privacy@azerion.ai. If we become aware that we have collected personal data from a child under 18 without verification of parental consent, we will take steps to delete that information from our servers.

11. SPECIFIC JURISDICTIONS

We provide additional information about the processing of your data for visitors and users located in certain specific jurisdictions:

11.1 United States (California and other states with similar laws) This section provides disclosures and serves as a Notice at Collection under laws like the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), Utah Consumer Privacy Act (UCPA), Virginia Consumer Data Protection Act (VCDPA), and Delaware Personal Data Privacy Act (DPDPA).

  • Categories of Personal Information Collected: As described in Section 2 ("Personal Data We Process").
  • Purposes of Collection and Use: As described in Section 3 ("Why We Process Your Personal Data").
  • Categories of Personal Information Disclosed for a Business Purpose: As described in Section 5 ("To Whom We Disclose Your Personal Data").
  • "Sale" or "Sharing" of Personal Information: Azerion Intelligence does not "sell" your personal information in the traditional sense of exchanging it for monetary consideration. We also do not "share" your personal information for cross-context behavioral advertising as currently defined under the CPRA, unless explicitly stated and with your consent (e.g., through cookie banners for certain marketing cookies).
  • Your Rights: Depending on your state of residence, you may have certain data rights, including:
    • The right to know/access what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you.
    • The right to delete personal information that we have collected from you, subject to certain exceptions.
    • The right to correct inaccurate personal information that we maintain about you.
    • The right to opt-out of the "sale" or "sharing" of your personal information (as applicable).
    • The right to limit the use and disclosure of sensitive personal information (if we collect it and use it for purposes other than those permitted by law).
    • The right not to receive discriminatory treatment for exercising your privacy rights.
  • Exercising Your Rights: If you wish to exercise any of your rights, please contact our Privacy Office at privacy@azerion.ai. We will verify your identity before processing your request, which may require you to provide additional information. If you use an authorized agent to make a request, we may require proof of their authorization. You have the right to appeal a denial of any of these rights by contacting us.
  • Profiling: We do not engage in profiling that produces legal or similarly significant effects using your personal data in a manner that would require an opt-out under these state laws without appropriate notice and choice.

11.2 Canada If you are a resident of Canada, you may have the following rights under Canadian privacy laws (e.g., PIPEDA):

  • The right to access your personal information and information about how it is processed.
  • The right to request that inaccurate personal information is corrected.
  • The right to request deletion of personal information under certain circumstances.
  • The right to withdraw your consent to our processing of your personal information for a specified purpose (withdrawal will not affect the lawfulness of processing before withdrawal).
  • The right to lodge a complaint with the Office of the Privacy Commissioner of Canada if you have concerns about our handling of your personal information.

12. YOUR RIGHTS UNDER GDPR (FOR ALL USERS)

As Azerion Intelligence is established in the Netherlands, we are subject to the General Data Protection Regulation (GDPR). Regardless of your location, if GDPR applies to the processing of your personal data, you have the following rights:

  • The right to access: You have the right to request copies of your personal data from us.
  • The right to rectification: You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
  • The right to erasure (right to be forgotten): You have the right to request that we erase your personal data, under certain conditions.
  • The right to restrict processing: You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • The right to object to processing: You have the right to object to our processing of your personal data, under certain conditions (e.g., for direct marketing or processing based on legitimate interests).
  • The right to data portability: You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions, in a structured, commonly used, and machine-readable format.
  • The right to withdraw consent: If we are processing your personal data based on your consent, you have the right to withdraw that consent at any time.
  • The right not to be subject to automated decision-making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, under certain conditions.

You also have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your habitual residence, place of work, or place of the alleged infringement if you consider that the processing of your personal data infringes the GDPR. 13. UPDATES TO THIS PRIVACY POLICY

Our business is constantly developing and changing, and our Privacy Policy may also change to reflect these changes, legal requirements, or updates in our data processing practices. We may update this Privacy Policy from time to time and will publish the new version on our websites. We recommend you review this Privacy Policy periodically. If we make any material changes, we will provide notice through our Platform, by email, or by other appropriate means.
